Public bodies’ debts to businesses: late-payment interest runs without a formal demand
Decreto-Lei n.º 180/2026, in force since 10 September, writes into the regulation on late payments by public bodies that, once the 30 or 60-day period ends, creditors are entitled to late-payment interest without a formal demand, at the Commercial Code rate.
Affordable rental: new regime in force since 1 September, with full exemption from income tax
The Regime Simplificado de Arrendamento Acessível and the Contratos de Investimento para Arrendamento, both from Decreto-Lei n.º 97/2026, took effect on 1 September and repealed the former Programa de Apoio ao Arrendamento. Rents are exempt from IRS (personal income tax) and IRC (corporate income tax) if the contract respects the municipal rent ceiling and the minimum term, and the landlord files it with IHRU by 15 January of the following year.
Public procurement: direct award rises to €150,000 for works and €75,000 for services
Decreto-Lei n.º 177/2026 is the most extensive revision of the Código dos Contratos Públicos (Portuguese public procurement code) since 2017 and comes into force on 1 October. Every direct award and prior consultation threshold goes up, companies with tax debt up to €10,000 are no longer automatically excluded, and it becomes possible to propose a contract to the State on your own initiative.
